GENERAL TERMS AND CONDITIONS OF SALE AND USE
CELICERCA ONLINE STORE
These Terms and Conditions govern the use of the Celicerca online store and purchases made through the website, in accordance with applicable Portuguese law, in particular Decree-Law no. 24/2014, Decree-Law no. 84/2021, Law no. 24/96, Law no. 144/2015 and the General Data Protection Regulation (GDPR).
I. Deliveries and returns
Orders are normally dispatched and delivered within an estimated 8 to 12 business days from confirmation of payment, without prejudice to delays attributable to the carrier or caused by force majeure.
Shipping costs are always borne by the customer, unless expressly stated otherwise or covered by a promotion announced by the company. Where a customer places several separate orders, even on the same day, shipping costs are charged separately for each order because they constitute separate shipments.
II. Shipping costs and methods
The company uses specialised, reputable carriers to ensure safe, high-quality delivery. Every shipment includes a tracking number, which is sent to the customer by email after dispatch.
Large or heavy items may be shipped on a pallet and carried by a heavy goods vehicle (semi-trailer). In such cases, the customer must ensure that the delivery location is suitable for unloading and has the necessary technical and human resources. If unloading is impossible because these conditions are not met, additional costs or rescheduling may be required and will be borne by the customer.
The shipping cost is calculated automatically at checkout according to the destination and weight of the products.
III. Order processing
Orders are processed on business days only. Orders confirmed by 3:00 p.m. are generally processed on the same business day; orders placed after that time, at weekends or on public holidays are processed on the next business day.
If the delivery postcode is outside the distribution area, the customer must contact Customer Support on 249 095 284 or at geral@celicerca.com so that delivery feasibility and conditions can be assessed.
IV. Right of withdrawal (returns)
Under Decree-Law no. 24/2014 of 14 February, consumers have 14 days from receipt of the order to withdraw from the contract without giving a reason. A return may be requested through the website or Customer Support.
After the returned item has been received and inspected, the customer may choose either reimbursement by bank transfer, for which the relevant IBAN must be provided, or a shopping voucher for the same amount, valid for six months in CELICERCA physical stores or the online store.
The returned item must be in the condition in which it was received, without signs of use beyond what is necessary to establish its nature, characteristics and operation, and should, whenever possible, be returned in its original packaging with all accessories and documentation.
When the right of withdrawal is validly exercised, reimbursement will be made within 14 days of notification. As permitted by law, it may be withheld until the returned goods or proof of dispatch are received, whichever occurs first. Direct return costs are borne by the consumer unless CELICERCA expressly accepts them or the goods are defective or non-conforming for reasons attributable to the seller.
V. Complaints Book
The Complaints Book is available at our premises at Zona Industrial de Vilar dos Prazeres, Rua da Indústria, Caneiro, 2490-742 Ourém, and through the official Electronic Complaints Book portal.
VI. Payments
Celicerca provides secure and reliable payment methods for a simple, fast and protected purchasing experience. Payment may be made by bank transfer.
Celicerca adopts appropriate technical and organisational measures to protect online transactions. Bank details and payment-method information are not stored in our systems; such data are processed securely and in accordance with applicable law.
VI. Invoicing
Once payment has been confirmed, the invoice is issued and sent automatically to the email address supplied by the customer. A Tax Identification Number (NIF) must be entered correctly during checkout if it is to appear on the invoice. Once issued, an invoice can only be amended where legally permitted.
Orders paid by bank transfer remain reserved for up to 48 hours after checkout. If payment is not received or evidenced within that period, the order is automatically cancelled without prior notice. VII. Terms and conditions of use
These Terms and Conditions govern access to, browsing and use of the www.celicerca.pt Online Store and the purchase of products sold through it. The Online Store is owned by Celicerca, with registered office at Zona Industrial de Vilar dos Prazeres, Rua da Indústria, Caneiro, 2490-742 Ourém, legal person no. 510 045 774, registered with the Ourém Commercial Registry.
By accessing, browsing or purchasing through the Online Store, the user confirms that they have read, understood and fully accepted these Terms and Conditions, the Privacy Policy and the Cookie Policy. Use of the store gives the user Customer status and entails full, unconditional acceptance of the policies in force on the date of use. Anyone who does not agree, in whole or in part, must refrain from using the store or placing an order.
Celicerca may amend or update these Terms and Conditions at any time without prior notice. Changes are published on the website and take effect upon publication. Customers are responsible for consulting the current version periodically.
Customers must provide complete, truthful, accurate and up-to-date information when registering or ordering, update it when it changes, and are solely responsible for false, inaccurate or outdated statements and any resulting loss suffered by Celicerca or third parties.
Celicerca is the controller of its customers' personal data and processes them under Regulation (EU) 2016/679, Law no. 58/2019 and other applicable Portuguese and European law. Personal data are processed only for the purposes described in the Privacy Policy, including order management, performance of sales contracts, compliance with legal obligations and customer support. Celicerca implements appropriate measures to protect data security, confidentiality and integrity.
Because of the nature of the Internet and public communications networks, electronic transmissions cannot be guaranteed to be entirely free from failures, interruptions or unauthorised access. Celicerca is not liable for loss caused by technical failures, cyberattacks, viruses, service interruptions or events not directly attributable to it.
The Online Store must be used lawfully, in good faith and in accordance with these Terms. Customers may not use it for unlawful or fraudulent purposes, introduce viruses, malware or malicious code, attempt unauthorised access to Celicerca systems, or compromise the store's operation, availability or security. In the event of a breach, Celicerca may suspend or cancel access immediately, without prejudice to any other legal rights and remedies.
Online contracts are available only to persons legally capable of contracting. By ordering, the Customer declares that they are at least 18 years old or otherwise have legal capacity, act on their own behalf or have authority to represent the contracting entity, and have supplied complete and truthful information. Celicerca may refuse or cancel orders where there are indications of fraud, false information or breach of these Terms.
IX. Online purchasing procedure
The Customer selects products and adds them to the shopping cart. Prices are shown in euros and include VAT at the statutory rate unless expressly stated otherwise. Product photographs are illustrative and minor differences may exist; customers must read the description and essential characteristics and may contact Customer Support with questions. Celicerca makes reasonable efforts to keep website information accurate, current and complete and may correct typographical or technical errors at any time.
The product price is the total amount payable, excluding any applicable transport costs displayed before confirmation. To complete a purchase, the Customer must provide their full name or company name, NIF/NIPC, billing address, delivery address where different, email address and telephone number, and is responsible for the accuracy of those details.
Before final submission, an order summary displays the products, quantities, total price, applicable shipping costs, billing and delivery details and selected payment method. The Customer must check and correct it before confirmation. Celicerca then sends an acknowledgement by email; this does not by itself constitute final acceptance, which occurs only after product availability and dispatch or collection have been confirmed.
Where advance payment is not required, payment is made on delivery or collection using an available method. The invoice is issued in accordance with tax law in physical or electronic form. Free collection is available at Celicerca's premises at Rua da Indústria, Zona Industrial de Vilar dos Prazeres, 2490-742 Ourém.
On delivery or collection, the Customer must check the quantity, packaging, apparent condition and conformity of the products and immediately report damage or non-conformity. Celicerca delivers within the European Union in areas covered by its transport services. Delivery times are estimates and may change for logistical reasons or force majeure.
If a product becomes unavailable after ordering, Celicerca will inform the Customer as soon as possible and no later than 30 days, and may propose a new delivery date, propose an equivalent product with the Customer's consent, or reimburse all amounts paid if the order cannot be fulfilled.
The Customer must ensure that an authorised person is present at the delivery address. If delivery fails for reasons attributable to the Customer, the cost of a new attempt may be charged. Irregularities should be reported as soon as possible, preferably on the delivery date, to Customer Support on +351 249 095 284, Monday to Friday, 8:30 a.m.-12:30 p.m. and 2:00 p.m.-6:00 p.m.
The consumer may withdraw within 14 days of receiving the products by sending Celicerca an unequivocal statement. Products must be returned within 14 days of that notice. Except where the return results from a Celicerca error or lack of conformity, direct return costs are borne by the Customer. Reimbursement is made within the statutory 14-day period and may be withheld until the goods or proof of dispatch are received.
Without prejudice to withdrawal and statutory conformity rights, Customers may request an exchange or return in legally permitted circumstances. Celicerca bears all transport costs where the return results from a defect, lack of conformity or its own error; in all other cases, return costs are borne by the Customer.
Complaints may be submitted in writing through Customer Support or the website contacts. The Electronic Complaints Book is available at https://www.livroreclamacoes.pt.
These Terms and Conditions are governed by Portuguese law. In a consumer dispute, the Customer may use a Consumer Alternative Dispute Resolution (ADR) entity.
